In an April 2024 op-ed for The Philadelphia Inquirer, Dr. Laura Sinko responded to the New York Court of Appeals decision overturning Harvey Weinstein's 2020 rape conviction. Writing as a sexual assault nurse examiner in Philadelphia and Our Wave's director of research and evaluation, she argues that the ruling should push the city and the nation to rethink how the justice system treats survivors.
Dr. Sinko describes the barriers she has seen survivors face in her clinical work, including fear of being retraumatized or blamed and the strain of a complex legal process. She argues that the decision deepens those fears and may discourage others from coming forward. The prospect of testifying again at a new trial, she writes, is an enormous emotional burden. The ruling also sends a painful message that survivors' voices can be called into question even after a jury has believed them.
Dr. Sinko calls on Philadelphia to build a justice system that puts survivors' well-being first. Her recommendations include:
Stronger partnerships among law enforcement, advocacy groups, and support services throughout the legal process
Mandatory trauma-informed training for police, prosecutors, and judges who handle sexual violence cases
Working with state legislators on clear rules for admitting evidence of past sexual misconduct, so trials stay fair
Stronger protections for survivors against retaliation, including defamation lawsuits, and stronger privacy safeguards
Dr. Sinko acknowledges that the justice system still has far to go in believing and supporting survivors. Even so, she sees the moment as a call to action. She argues that Philadelphia can lead by example by adopting a more compassionate, trauma-informed approach. In doing so, the city can show survivors that it stands with them and that they can speak their truth without fear.
